QRakshak · Legal
Terms of Service
Effective: 29 October 2026 · Version 2.1 · Operated by ThinkAIQ LLP
In short: QRakshak is a safety aid, not an emergency service. Use it lawfully, never to track or harass anyone. We aim for reliable alerts but cannot guarantee that a network, phone or third-party provider will deliver them.
These Terms of Service (“Terms”) are a legal agreement between you and ThinkAIQ LLP (“QRakshak”, “we”, “us”). By creating an account, activating a QR, scanning a QR, or using the Service, you agree to these Terms, our Privacy Policy and our Disclaimer. If you do not agree, do not use the Service.
1. Definitions and the Service
The Service is a safety-first QR platform. It lets a QR owner publish a limited safety profile, lets a helper scan a printed QR to see masked contact options, sends family alerts, and can connect a masked call or show a 112 dial intent. The Service may include the website, mobile apps, printed QR products, dashboards for schools and partners, and support channels.
What the Service is not: it is not a police, ambulance, fire or government emergency service; it does not dispatch help; it does not automatically dial 112; and it does not guarantee that any call, message or alert will be delivered. See section 8.
2. Eligibility and authority
- You must be at least 18 years old to create an account.
- You must have the legal capacity to enter into a contract and must provide accurate, current information.
- If you create a profile for a child, student or another person, you confirm that you are their parent/guardian, an authorised school, or have their lawful authority to do so, and that you have obtained the consents required by the DPDP Act.
- If you use the Service for an organisation, you confirm you are authorised to bind that organisation.
3. Your account and security
- Keep your PIN, device and email secure. You are responsible for activity under your account, except where caused by our breach.
- Use a PIN that is not easy to guess, and tell us immediately about unauthorised access, a lost device, or a suspected data breach.
- We may bind sessions to a device and may require re-verification for sensitive actions (PIN change, device removal, account deletion).
- You must not share an account or sell access to it.
4. Licence to use the Service
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your personal safety or your organisation's internal safety purposes. A licence to a digital QR and any physical QR product is for the term stated at purchase and is subject to payment.
5. Acceptable use
You must not, and must not allow anyone else to:
- Stalk, harass, threaten, surveil or track any person, or use the Service to locate or contact someone without lawful authority.
- Create a QR for another person without their consent (or a guardian's verified consent for a child), or publish someone else's personal data without permission.
- Trigger false emergencies, spam alerts, or abuse the emergency call/alert features.
- Scrape, crawl, bulk-scan or automate access to QR pages or the API, or bypass rate limits, CAPTCHAs or other controls.
- Reverse engineer, decompile, or attempt to extract source code or secrets, except where the law expressly permits it.
- Probe, scan or test the vulnerability of the Service without our prior written authorisation (see our Security Policy for responsible disclosure).
- Upload malware, unlawful content, or content that infringes intellectual property, privacy or other rights.
- Use the Service in a way that violates the DPDP Act, the IT Act 2000, the Consumer Protection Act 2019, telecom regulations, or any other applicable law.
- Resell, sublicense or white-label the Service without a separate written agreement.
We may suspend or terminate an account immediately and without refund if we reasonably believe these rules have been broken, if required by law, or if continuing would put someone at risk.
6. Your content and personal data
- You retain ownership of the content and personal data you upload.
- You grant us a limited licence to host, process, encrypt, transmit and display that content solely to operate the Service and meet legal obligations.
- You are responsible for the accuracy of the data you publish. An inaccurate medical note, phone number, blood group or pickup person can cause real harm.
- Emergency contacts: before adding a person's name, phone number or email as an emergency contact, you confirm that you have informed them and obtained any consent required by law. We process their details only to send the alerts/calls you trigger and to keep the safety record.
- Our processing of personal data is described in the Privacy Policy. You can exercise your rights through Your Data Rights.
- You may export your QR data before closure; we will provide a machine-readable export on a verified request.
7. Third-party services and number masking
Alerts, emails, push notifications and calls are delivered through third-party providers (for example email, push and telephony providers listed on /legal/sub-processors). Their networks, policies and outages are outside our control. Masked calling uses a virtual number; the provider receives the destination number server-side to connect the call. Masking is mandatory in the woman-safety category. A provider may change or discontinue a virtual number.
7.1 App store terms
If you download the app from the Apple App Store or Google Play, the store's terms also apply. For the Apple App Store: Apple is not a party to these Terms and has no obligation to provide maintenance or support for the app; Apple is a third-party beneficiary of these Terms and may enforce them; we (not Apple) are responsible for the app, its content, any product claims, and any claim that the app infringes intellectual property; you confirm you are not located in a country subject to an applicable embargo and are not on a prohibited-party list. Apple's standard end-user licence terms apply where they are stricter than these Terms.
8. Emergency and safety limitations
QRakshak is not a replacement for emergency services. In any emergency, call 112 (or the appropriate local emergency number) yourself.
- We provide a 112 dial intent only; we never auto-dial, and we cannot guarantee that a call connects.
- Delivery of email, SMS, push or voice alerts depends on networks, devices, carriers and third-party providers. Delivery is not guaranteed.
- Location shared through the Service is approximate and is provided only when a user chooses to share it. It is not a live tracking service.
- Medical information is user-provided and may be incomplete or wrong. Helpers must use their own judgement and call professional help.
- QR stickers can be damaged, removed or copied; scanning depends on lighting, camera and surface.
- We may suspend the Service for maintenance, security or legal reasons. We target high availability but do not promise uninterrupted service.
9. Payments, fees and taxes
- Prices are shown in Indian Rupees and include or exclude GST as stated at checkout.
- A licence or product is activated after payment is confirmed. We may issue a receipt or tax invoice.
- You are responsible for any bank, card, UPI or payment-provider charges, unless the law says otherwise.
- Failure to pay may result in suspension of paid features. Emergency features that are free will remain available where we say so.
- Refunds and cancellations are governed by our Refund & Cancellation Policy and applicable consumer law.
10. Availability and changes to the Service
We may improve, change or discontinue features. We will give reasonable notice of a material change that reduces a paid feature, and a pro-rata refund or credit where required. A target uptime figure is an operational goal, not a contractual guarantee, unless a separate written service-level agreement says otherwise.
11. Intellectual property
The Service, software, design, text and the “QRakshak” name and logo are owned by us or our licensors and are protected by Indian and international law. You may not use our marks without written permission. Feedback you send may be used to improve the Service without obligation, but we will not publish your personal data.
12. Privacy and data protection
We process personal data as described in the Privacy Policy. For white-label deployments, the partner is the Data Fiduciary and we act as its Data Processor under a separate agreement. If you are a partner, you must have a lawful basis for the data you upload and must pass on the required notices to your users.
13. Suspension and termination
- You may stop using the Service and request deletion at any time via /legal/delete-account.
- We may suspend or terminate for a material breach, non-payment, unlawful use, a risk to safety, or where required by law.
- Where practical, we will give notice and an opportunity to export data before termination — except for serious safety, security or legal reasons, where immediate action may be needed.
- On termination, your right to use the Service ends. Sections that by nature survive (liability, indemnity, governing law, IP) continue to apply.
14. Disclaimer of warranties
To the maximum extent permitted by law, the Service is provided “as is” and “as available”. We disclaim implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the Service will be error-free, secure, or available at a particular time, or that any alert, call or message will be delivered. Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded — including your rights under the Consumer Protection Act 2019.
15. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of profit, revenue, goodwill, data or opportunity, arising from the Service.
Our total aggregate liability for all claims relating to the Service in any 12-month period is limited to the higher of (a) the amount you paid us for the Service in the 12 months before the event giving rise to the claim, or (b) INR 10,000.
Nothing in these Terms limits liability for fraud, wilful misconduct, death or personal injury caused by negligence, or any liability that cannot be limited under applicable law. Because the Service is a safety aid, you must always keep an independent way to call emergency services.
16. Indemnity
You agree to indemnify and hold harmless ThinkAIQ LLP, its directors, employees and agents from claims, losses, liabilities and reasonable legal costs arising from: (a) your breach of these Terms or applicable law; (b) content or data you upload without lawful authority; (c) your misuse of the Service (including stalking, harassment or false alerts); or (d) a dispute between you and a third party. We will promptly notify you of a claim and may participate in its defence.
17. Force majeure
We are not liable for a failure or delay caused by events beyond our reasonable control, including network or carrier outages, telephony or cloud-provider failures, power cuts, natural disasters, epidemics, war, civil unrest, government action, or a cyberattack that could not reasonably be prevented. We will use reasonable efforts to restore the Service.
18. Complaints, takedown and grievance
If content on the Service infringes your rights or is unlawful, write to our Grievance Officer at contact@thinkaiq.com with enough detail to identify the content and your right. We acknowledge within 1 days and aim to resolve within 15 days, as required by applicable law, including the IT Rules. We may remove content, suspend an account, or preserve records where legally required. See /legal/grievance.
19. Governing law and disputes
These Terms are governed by the laws of India. Subject to any mandatory consumer-protection forum, the courts at Patna, Bihar, India have exclusive jurisdiction. Before going to court, please raise the issue with our Grievance Officer and give us 30 days to resolve it. Nothing prevents you from approaching a consumer commission or the Data Protection Board of India where the law allows.
20. Changes to these Terms
We may update these Terms. Material changes will be notified at least 30 days in advance by email or in-app notice, with the new version and effective date published on this page. Continued use after the effective date means you accept the updated Terms. If you do not agree, you may stop using the Service and request deletion before the change takes effect. Changes required by law may take effect sooner.
21. General
- Severability: if a provision is invalid, the rest remains in force and the invalid provision is replaced by the closest lawful meaning.
- Entire agreement: these Terms, the Privacy Policy, the Disclaimer, the Refund Policy and any signed order form are the entire agreement.
- No waiver: a delay in enforcing a right is not a waiver.
- Assignment: you may not assign these Terms; we may assign them to a successor in connection with a merger or sale, with notice.
- Language: the English version prevails. Translations are for convenience.
- Notices: legal notices to us must go to contact@thinkaiq.com; notices to you go to the email/phone on your account or in-app.
